Plain-English summary. Dwelfy is a research tool for US real estate investors and renters. We pull listings, public records, and tax-rate data so you can analyze deals faster — but we are not a registered investment adviser, broker-dealer, real estate brokerage, mortgage lender, or tax preparer. Nothing on the site is investment, tax, or legal advice. You are responsible for your own due diligence before buying, selling, or signing any agreement.

1. Introduction

These terms and conditions ("Terms") govern your use of the Dwelfy website and services operated by Dwelfy ("we", "us", or "our"). By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the service.

2. Property Information Disclaimer

All property information displayed on this platform — including listings, addresses, prices, square footage, beds/baths, photos, school ratings, and tax estimates — is provided for informational purposes only and is sourced from third-party portals and public records. While we work to keep data accurate, we make no representations or warranties about the completeness, accuracy, or currency of any listing, valuation, or calculator output. Inventory turns over rapidly and listings may be stale, withdrawn, or under contract by the time you view them.

3. Investment Risk Disclaimer

Real estate investing carries inherent risk, including loss of principal, liquidity risk, and exposure to local market conditions. Past performance does not guarantee future results. ROI, cap rate, cash-on-cash return, BRRRR exit equity, and any other figure produced by our calculators are theoretical estimates based on the inputs you provide and the assumptions described next to each tool. They are not a guarantee of actual returns and should not be used as the sole basis for any investment decision. You should consult a licensed real estate professional, CPA, or attorney before committing capital.

4. Tax-Related Calculator Disclaimer

Calculators that estimate federal or state taxes (property tax, transfer tax, capital gains, depreciation, 1031 exchange) use published statewide median rates and current federal rules to the best of our knowledge as of the date printed on each tool. Local jurisdictions (county, city, school district) often layer additional taxes on top, and tax law changes frequently. Outputs are estimates only and do not constitute tax advice. Consult a CPA or tax attorney licensed in your state before relying on any figure for an actual transaction.

5. Nature of the Service

Dwelfy is a property research and analysis tool. We aggregate publicly available listings and public records (county recorder, tax assessor, MLS-syndicated feeds where licensed) to help users analyze the US residential real estate market. Dwelfy is not:

  • a registered investment adviser (RIA) under the Investment Advisers Act of 1940 or any state equivalent;
  • a broker-dealer registered with FINRA or the SEC;
  • a licensed real estate broker, agent, or brokerage in any state;
  • a mortgage lender, mortgage broker, or loan originator;
  • a CPA, tax preparer, or tax adviser;
  • an attorney or law firm.

Information presented on the platform constitutes neither legal, tax, nor financial advice. Users are responsible for verifying any figure against the underlying source and for ensuring their own activities comply with applicable federal, state, and local law (including, where relevant, fair-housing, anti-discrimination, landlord-tenant, and disclosure requirements).

6. User Accounts

Users are responsible for maintaining the confidentiality of their account credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are engaged in fraudulent activity. You must be at least 18 years old to create an account. Accounts are personal and may not be shared.

7. Acceptable Use

You agree not to use the platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair the service. Specifically you must not:

  • scrape, crawl, or systematically extract data from the platform without our prior written permission;
  • reverse-engineer or attempt to derive the source code of any component;
  • use Dwelfy data to build a competing product or service;
  • upload content that is unlawful, harassing, defamatory, or that infringes a third party's rights;
  • use the platform to discriminate against any protected class under the federal Fair Housing Act or any state or local fair-housing law.

8. Subscriptions and Payments

Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed by Stripe under their terms. You authorize Dwelfy and Stripe to charge the payment method on file each billing cycle until you cancel. You may cancel at any time from your account settings; cancellations take effect at the end of the current billing period and are not pro-rated. We do not provide refunds for partial months. Free-trial terms (where offered) are described at the point of sign-up and supersede this section to the extent of any conflict.

9. DMCA / Copyright Notices

Dwelfy respects intellectual property rights. If you believe content on the platform infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) to [email protected] including: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) the URL of the allegedly infringing material; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; (f) a statement under penalty of perjury that the information is accurate and you are the rights-holder or authorized to act on their behalf. We will respond to valid notices in accordance with the DMCA.

10. Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information, including rights you may have under the California Consumer Privacy Act (CCPA/CPRA) and other state privacy laws.

11. Third-Party Links and Listings

Listings displayed on Dwelfy originate from third-party portals and remain the property of their respective listing agents and brokerages. Clicking through to an outside site, contacting an external agent, or completing a transaction with a third party is at your own risk and subject to that party's terms and privacy practices.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DWELFY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. DWELFY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DWELFY IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) US$100. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, IN WHICH CASE THE FOREGOING LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to indemnify and hold harmless Dwelfy and its affiliates from any claim, demand, loss, or damage (including reasonable attorneys' fees) arising from (a) your use of the service in violation of these Terms, (b) content you submit to the platform, or (c) your violation of any third-party right or applicable law.

14. Account Termination

You may close your account at any time by contacting us at [email protected]. Upon termination, your right to use the service ceases immediately. We retain data after termination as described in the Privacy Policy and as required by applicable law.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be posted on the platform and, where we have your email, sent to you at least 14 days before taking effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.

16. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. (NOTE FOR THE OPERATOR: change this clause to the state where your entity is incorporated or principally does business, after consulting US counsel.) Any dispute arising out of or relating to these Terms or the service will be resolved in the state or federal courts located in [Delaware county / your jurisdiction], and you consent to personal jurisdiction there. You and Dwelfy each waive the right to a trial by jury and to participate in a class action to the extent permitted by law.
